Orlando, FL Adopts Ordinance Regarding Secondary Metal Recycling The City Council adopted Ordinance 2010-19, Creating Section 43.90-43.92, Orlando City Code, to be entitled "Secondary Metals Recyclers". With the cost of metal rising as well as the demand for copper, aluminum and other non-ferrous metals, there has been an increase in scrap metal thefts. In 2009, there were 130 copper/precious metal thefts within the city limits of Orlando.
Even though the Legislature enacted stricter guidelines for secondary metals recyclers in October 2008, by amending Florida Statute section 538, there continues to be a large number of metal thefts within the City. The adopted ordinance contain conditions which are more restrictive than the state statute and are intended to make it more difficult and less desirable for individuals to steal metal and in turn, sell it to a secondary dealer.
Sections 43.90 - 43.92 will prohibit secondary metals recyclers from entering into cash transactions in excess of $50 (rather than $1,000) with the same seller in a single day and require any payment to a seller in excess of $50 to be made by check and mailed to a seller's physical street address.
