Manatee County, FL to Hold Discussion of possible Gambling Regulations
The County Commission will discuss drafting an ordinance regarding regulation of gambling operations (Bingo) within Manatee County. In a recent Request for Legal Services a question was posed to the County Attorney's Office by Commissioner Bustle requesting an opinion whether the County has the authority to regulate for.profit and non-profit organizations that conduct raffles, dances, games, etc. and that award non-monetary prizes. The County Attorney's Office responded that local regulations of all gambling operations has not been preempted by the state. The County Attorney has now been asked by Commissioner Bustle to research and review other ordinances by Florida counties regulating gambling activities, and to present an ordinance from another county to serve as a possible model for discussion among the Board of County Commissioners. The two ordinances attached concern bingo since this is the only form of gambling that we have found that has any local regulation in Florida. One is a very short ordinance that simply restricts the use of a "structure" to play bingo to two days per week. The other is a comprehensive licensing and regulatory ordinance of all bingo operations. We noted that at least one county was regulating general gambling through its public nuisance ordinance but the other counties seemed content to regulate just bingo.
