Cutler Bay, FL Parking Security Camera Ordinance Affected by SB 360
The Town Council approved an ordinance creating regulations related to malls and businesses with parking lots containing 25 or more parking spaces; providing for installation of security camera systems for parking lot surveillance; providing for a procedure for malls and businesses to keep recordings for 72 hours; providing for an exemption for convenience businesses already governed by similar Florida Statutes; providing technical specifications for a security camera system; creating a grace period for compliance for existing malls and businesses; amending the schedule of violations and civil penalties section of the code to include penalties for violation of these sections; repealing all ordinances in conflict.

Issue History
06/02/09On 6/1/09, Governor Crist signed SB 360 preempting Local Governments from adopting local security camera ordinances, in addition to other Growth Management provisions.
01/22/09The ordinance was approved at the 1/21/09 meeting. The Council vote was 3-2, Vice Mayor Ed MacDougall and Council member Timothy Meerbott voted against the ordinance.
01/13/09The Town Council will hold the second reading and public hearing at the 1/21/09 meeting.
12/17/08The Town Council plans to continue the second reading in January 2009.
11/14/08The Town Council will continue the second reading and hold a public hearing at the 11/19/08 meeting.
11/06/08The Town Council held a second reading at the 10/15/08 meeting. (Note: OrdinanceWatch has monitored Cutler Bay since November 2008)
