Mary Esther, FL to Consider Renewal of Electric Franchise with FPL
The City’s electric franchise with Gulf Power Company (now Florida Power & Light Company,
or FPL) was granted by Ordinance 2011-08, adopted January 9, 2012, for a fifteen-year term and
expires on or about January 9, 2027. FPL has provided its standard renewal ordinance for a
thirty-year term. The City Attorney reviewed the FPL form and prepared a redline dated August
11, 2026; staff added one proposed paragraph, described below. The attached draft shows all
proposed changes to the FPL form in legislative format (additions underlined, deletions struck
through).
Staff is presenting the draft as a discussion item to obtain Council direction on the substantive
policy questions before the ordinance is finalized. The City Attorney will handle all revisions to
the legal provisions and will negotiate the final language with FPL. For reference, the franchise
the City of Niceville adopted with FPL in May 2026 is attached; it is the same FPL form and is a
useful example of terms recently negotiated with FPL in Okaloosa County.
Issue History
